1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the website located at pawsdogdaycare.ca and all services offered by 1543851 Alberta Ltd operating as PAWS Dog Daycare Calgary ("PAWS", "we", "us", or "our").

By accessing our website or using any of our services, you agree to be bound by these Terms and all applicable laws and regulations. These Terms apply to all visitors, customers, and others who access or use our website or services.

If you do not agree to these Terms, in whole or in part, you must not access our website or use our services. Your continued use of our website or services following any modifications to these Terms constitutes your acceptance of those changes.

2. Services

PAWS Dog Daycare Calgary provides the following pet care services:

Dog Daycare

Kennel-free, supervised group daycare with daily pack walks. Dogs are grouped by size and temperament. All daycare dogs must pass an evaluation prior to attending.

Grooming

Full-service grooming for dogs of all breeds and sizes, including specialized services for reactive dogs, puppies, and rescue dogs. Grooming services include baths, haircuts, nail trims, ear cleaning, and other hygiene services.

PAWS Pros (In-Home Services)

Professional in-home pet sitting and dog walking services provided by trained PAWS staff at the client's residence.

Training

Dog training programs designed to support positive behaviour in social and home environments.

Pet Photography

Professional pet photography sessions conducted at our facility or at agreed-upon locations.

Birthday Parties

Dog birthday party packages hosted at our facility, including supervised play and optional add-ons.

3. Online Services

PAWS provides the following digital services and platforms:

Website (pawsdogdaycare.ca): Informational website providing details about our services, team, and facility.
Contact Form: Web-based contact form processed via Postmark email delivery. Submissions are sent directly to our team and are subject to our Privacy Policy.
Gingr Portal: Third-party client portal used for online booking, registration, pet profile management, and payment. Use of the Gingr portal is also subject to Gingr's own terms of service and privacy policy.
Online Shop (Stripe Payment Links): Our shop uses Stripe-hosted payment links for purchasing daycare packages and other products. When you click a "Buy" button, you are redirected to Stripe's secure checkout, which processes the transaction on Stripe's infrastructure. Use of Stripe's checkout is also subject to Stripe's terms of service and privacy policy.

4. Account Registration

Certain services, including booking and registration, require you to create an account through the Gingr client portal.

You must provide accurate, complete, and current information when creating and maintaining your account.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You must promptly notify us of any unauthorized use of your account or any other security breach.
You are responsible for ensuring that your pet's health records, vaccination status, and profile information are kept accurate and up to date. PAWS relies on this information to provide safe and appropriate care.
PAWS reserves the right to suspend or terminate accounts that contain false or incomplete information.

5. Purchases and Payment

Pricing

Current pricing for all services is available on our rates page. Prices are listed in Canadian dollars and are subject to applicable taxes. PAWS reserves the right to adjust pricing at any time with reasonable notice.

Payment

Payment for daycare packages, grooming appointments, PAWS Pro services, and other purchases is processed via credit card through the Gingr portal or via Stripe Payment Links from our online shop. By providing payment information, you represent and warrant that you are authorized to use the payment method provided and that all information supplied is accurate and complete.

Refunds and Cancellations

Used daycare visits and completed service appointments are non-refundable.
Unused visits remaining in a purchased daycare package may be credited to your account at PAWS' sole discretion. Refunds on unused package visits are not guaranteed.
Package credits do not expire unless otherwise specified at the time of purchase.
PAWS reserves the right to refuse or cancel orders in cases of suspected fraud, unauthorized transactions, or pricing errors.

6. Cancellation and No-Show Policy

Grooming and PAWS Pro Services

A minimum of 24 hours' notice is required to cancel or reschedule a grooming appointment or PAWS Pro service without penalty. Cancellations made with less than 24 hours' notice may be subject to a cancellation fee.

No-Show Policy

Clients who fail to attend a scheduled appointment without prior notice ("no-shows") may be charged a no-show fee equal to the full value of the missed service. Repeated no-shows may result in a requirement to prepay for future bookings or suspension of booking privileges.

Late Pickup

PAWS Dog Daycare closes at 7:00 PM. A late pickup fee of $25 per 15 minutes (or portion thereof) will be charged for dogs not picked up by closing time. This fee is assessed to cover the additional staffing required to care for your dog after hours.

Daycare Cancellations

Daycare bookings may be cancelled without penalty up to the time specified in the Gingr portal. Late cancellations may result in deduction of the visit from your package at PAWS' discretion.

7. Pet Care Liability

Owner Representations and Warranties

By enrolling your dog in any PAWS service, you represent and warrant that:

Your dog is current on all vaccinations required by PAWS (including rabies, distemper/parvovirus, and bordetella), as evidenced by veterinary records on file in the Gingr portal.
Your dog is in good health and free of any contagious illness at the time of each visit.
You have disclosed all known behavioural issues, medical conditions, and relevant history that may affect your dog's care or the safety of other dogs and staff.
You are the legal owner of the dog or have full authority to authorize care on behalf of the owner.

Owner Liability

You are solely liable for any damage to property, injury to other dogs, or injury to PAWS staff or third parties caused by your dog. This liability applies regardless of whether the incident occurs during daycare, grooming, a PAWS Pro visit, or any other PAWS service.

PAWS Liability

PAWS takes all reasonable precautions to ensure the safety and well-being of dogs in our care. However, PAWS is not liable for illness, injury, or death of your dog arising from normal daycare, grooming, or other service activities, except in cases of gross negligence or willful misconduct by PAWS staff.

PAWS reserves the right to obtain emergency veterinary care for your dog if deemed necessary. You authorize PAWS to do so and agree to be responsible for all veterinary costs incurred.

8. User Content

If you submit a review, testimonial, social media mention, or other content referencing PAWS or our services ("User Content"), you grant PAWS a non-exclusive, royalty-free, perpetual, and worldwide license to display, reproduce, and share that User Content for marketing and promotional purposes, including on our website and social media channels.

You represent that any User Content you submit is truthful, does not infringe on any third party's rights, and complies with all applicable laws. PAWS reserves the right to remove or refuse to display any User Content at our sole discretion.

9. Intellectual Property

All content on the PAWS website, including but not limited to text, images, photographs, logos, graphics, video, and software, is the property of 1543851 Alberta Ltd operating as PAWS Dog Daycare Calgary and is protected by applicable Canadian copyright, trademark, and intellectual property laws.

You may access and view website content for your own personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from this website without our prior written consent.

10. Third-Party Links and Services

Our website and services may contain links to or integrations with third-party websites and services, including but not limited to the Gingr client portal, Google Maps, Facebook, Instagram, and other platforms.

PAWS has no control over and assumes no responsibility for the content, privacy practices, or terms of any third-party website or service. The inclusion of a link or integration does not constitute an endorsement by PAWS. We encourage you to review the terms and privacy policies of any third-party service you use in connection with PAWS.

11. Privacy

Your privacy is important to us. The collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to our data practices as described in the Privacy Policy.

12. CASL Compliance

PAWS complies with Canada's Anti-Spam Legislation ("CASL"). We will only send commercial electronic messages (including promotional emails and newsletters) to individuals who have provided express or implied consent in accordance with CASL.

You may withdraw your consent to receive commercial electronic messages from PAWS at any time by clicking the unsubscribe link in any email we send or by contacting us at info@pawsdogdaycare.ca. Withdrawal of consent will not affect transactional messages related to active bookings or account activity.

13. PIPEDA Compliance

PAWS handles personal information in accordance with the Personal Information Protection and Electronic Documents Act ("PIPEDA") and, where applicable, Alberta's Personal Information Protection Act ("PIPA"). We collect only the personal information necessary to provide our services and do not sell or rent your personal information to third parties.

14. Limitation of Liability

To the fullest extent permitted by applicable law, PAWS, its principals, officers, directors, employees, contractors, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising from or related to your use of our services or website, including but not limited to loss of data, loss of revenue, loss of goodwill, or any other intangible losses.

In no event shall PAWS' total cumulative liability to you for any claims arising under or related to these Terms or our services exceed the total amount paid by you to PAWS for services in the twelve (12) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages; accordingly, the above limitations may not apply to you to the extent prohibited by applicable law.

15. Indemnification

You agree to indemnify, defend, and hold harmless PAWS and its principals, officers, directors, employees, contractors, agents, licensors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

Your use of or access to our website or services;
Your breach of any provision of these Terms;
Any damage, injury, or loss caused by your dog while in our care or on our premises;
Any false or inaccurate information you have provided to PAWS; or
Your violation of any applicable law or the rights of any third party.

16. Disclaimer of Warranties

Our website and services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, PAWS expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

PAWS does not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components. PAWS makes no representations or warranties regarding the accuracy or completeness of any content on our website.

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising out of or in connection with these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of the Province of Alberta, and you hereby consent to such jurisdiction and venue.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

19. Changes to Terms

PAWS reserves the right to modify these Terms at any time at our sole discretion. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify registered clients via email.

Your continued access to or use of our website or services after any changes to these Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using our website and services.
